BOOK-BOOK Chagama Terms of Service
These Terms of Service (hereinafter referred to as these “Terms”) set forth the conditions for use of the smartphone application “BOOK-BOOK Chagama” (hereinafter referred to as the “App”) provided by BOOK-BOOK Chagama (hereinafter referred to as the “Operator”). Users (hereinafter referred to as “Users”) shall use the App in accordance with these Terms.
Article 1 (Scope)
- These Terms apply to all relationships between Users and the Operator concerning use of the App.
- Various rules, guidelines, notices, and similar materials posted by the Operator in the App or on the official website (hereinafter referred to as “Individual Provisions”) form part of these Terms. If these Terms conflict with any Individual Provisions, the Individual Provisions prevail.
Article 2 (User Registration and Account Management)
- User registration is completed when a person who wishes to use the App agrees to these Terms, applies for registration by the method designated by the Operator, and the Operator approves the application.
- Users shall appropriately manage and safeguard their App accounts (including login credentials) at their own responsibility.
- Users may not, under any circumstances, transfer or lend their accounts to third parties.
- [Restriction on multi-device use] The App may limit simultaneous login and use to one device per account. If simultaneous use on multiple devices or sharing of an account among an unspecified number of people is discovered, the Operator may temporarily suspend or delete the account.
Article 3 (Copyright and Handling of Imported Data)
- Copyright in book data, images, text, and other content imported (uploaded) into the App by Users (hereinafter referred to as “User Data”) remains 100% with the User or the original rights holder, unchanged from before import.
- [Principle of data storage and communications] The App’s basic approach is to store User Data on the User’s own device (local storage). The Operator does not view or collect User Data itself (such as book content files) without authorization. However, only when Users use features provided by the App (data sync, backup, aggregation and display of reading statistics, and other related online services), the App may transmit, store, and process necessary data (such as reading history, statistical values, and account information) on servers managed by the Operator.
- [Disclaimer regarding copyright] Users shall import into the App only content for which they hold the copyright or other intellectual property rights, or for which they have obtained a lawful license. The Operator assumes no responsibility for disputes or damages arising from importing or using (including text-to-speech) illegally downloaded content or data that infringes third-party copyrights or other rights. Such matters shall be resolved entirely at the User’s own responsibility and expense.
Article 4 (Paid Plans and Payments)
- Users shall pay the fees separately specified by the Operator for paid plans (subscriptions, one-time purchase plans, and the like) through payment methods designated by the Operator (such as Stripe).
- [No-refund principle] As a rule, the Operator does not accept cancellations after payment is completed, refunds accompanying plan changes, prorated refunds, or any other refund requests.
- [Trial period] The Operator may offer new Users a free trial for a certain period (for example, 14 days). When the trial ends, Users are not automatically charged for a paid plan; they automatically move to the free plan. To continue using a paid plan, Users must subscribe or purchase again themselves.
Article 5 (Service Provision, Changes, and Additions)
- The App primarily operates in a local environment, but online features (such as speech synthesis APIs, character TTS, additional data downloads, and other features involving online communication) may be added, changed, or discontinued in the future, and Users agree to this in advance.
- The Operator may add, change, or discontinue App features without prior notice to Users.
Article 6 (Prohibited Conduct)
Users shall not engage in the following acts when using the App.
- Acts that violate laws or public order and morals.
- Acts related to criminal activity.
- Acts that destroy or interfere with the App’s servers, networks, or local systems (including AI engines).
- Analyzing, decompiling, disassembling, or reverse-engineering the App’s programs.
- Acts that may interfere with the Operator’s service operations.
- Impersonating a third party, or improperly sharing or using an account.
- Any other act the Operator deems inappropriate.
Article 7 (Disclaimers)
- [Disclaimer regarding AI accuracy limits] AI technologies used by the App (such as OCR text analysis, speech recognition, and TTS) do not guarantee 100% accuracy or complete operation. Even if Users suffer damages due to misrecognition, garbled text, misreading, temporary bugs, or other malfunctions, the Operator assumes no liability whatsoever (including refunds and damages).
- [Disclaimer regarding device dependence and operating environment] If part or all of the App becomes unusable due to the User’s device specifications, OS upgrades, browser specification changes, or similar causes, the Operator is not liable for resulting damages to Users.
- [Disclaimer regarding communications and external services] If some App features use external APIs or communications, and those features stop due to network outages or changes or failures of external services, the Operator assumes no liability whatsoever.
- The Operator assumes no responsibility for transactions, communications, or disputes between Users and other Users or third parties relating to the App.
Article 8 (Changes to the Terms)
When the Operator deems it necessary, it may change these Terms at any time without prior notice to Users. The amended Terms become effective when posted in the App or on the official website. If a User continues to use the App after a change, the User is deemed to have agreed to the amended Terms.
Article 9 (Governing Law and Jurisdiction)
- These Terms shall be interpreted in accordance with the laws of Japan.
- If a dispute arises regarding the App, the court with jurisdiction over the Operator’s location shall be the exclusive agreed court of first instance.
